View Full Version : Got rear ended and got a few questions

Ok so long story short..... I was sitting stopped waiting to make a left and WAM i got hit by a guy not looking at all. He had a turning lane to go into to avoid the STOPPED bike . All he kept saying is i couldnt tell you were stopped because your tail light was blinking...lol... you should have seen the gsp's face when he says this.... He was doing 45 mph.... I got launched and flew across the intersection . I got up right away...My tail bone hurts a little and im bruised up but i am happy to be alive.....

So my question is , im going to miss working { i own my own lawn care company} in the start of my busy season for at least a week as i am sore as hell , and my bike is totaled . So should i go to hospital and get that im hurt on paper ? Also what are the chances of me getting enought for my bike to get a new one like it... I am worried ill get some 1500$ offer and get screwed out of my bike... It only had 10k on it and was cherry...... Im lost on what to do ....

My only advice would be go to the hopital/doctor and get checked out. You may be hurt worse than you think and since this person hit you from behind I wouldn't think there will be any worries about who's paying the bill. Hopefully he had insurance.

WOW, you're a lucky man. I would probably get completely checked out by a Dr first. After all, your tailbone is connected to your backbone.
I think there a member here that is a MC accident attorney?

Yes, see a doctor. And unfortunately you are probably not going to get replacement cost for your bike, but you might. It's happened. But you might have to fight for it. And I second Rocker. There is a lawyer here that advertises on our site and you should at least talk to him or some lawyer. Did the driver have insurance? Do you have his insurance info? What king of insurance do you have? You probably have a good claim for lost income and medical expenses and even pain and suffering but you need an expert to help navigate the maze of insurance stuff. I'm trying to find the info for the lawyer/advertiser here but meanwhile there are other members that have used lawyers and will probably jump in with contact info.

I moved your thread to the open forum because it was in Board Information which is not likely to get much traffic unless people use the new posts button.

From what I've read, some back injuries may not appear until a year after the accident. Look up syringomyelia as an example. My advice, get checked out and do NOT settle your medical claim for at least a year. Settle the property damage portion when you are satisfied. Make sure the insurance company does not trick you by bundling thew settlements.

+1 on getting checked out. Like stated before you could have a back injury that could pop up later down the road and as long as its documented your set if it starts to give you trouble. Glad your gear did what it was supposed to.

what kind of bike were you on?

Insurance will pay KBB or NADA retail value to you in almost all cases we have dealt with.

In order to protect your self legally and most importantly physically you need to get checked out by a doctor and keep any and all records of it. Glad to hear that your ok. Any try not to worry as much about missing too much time at work because you can be compensated for all lost wages if everything goes your way.

echoing all the previous posts...glad to hear you're still breathing first of all...but go see a doc and Document everything...and even after all of this is said and done...continue to monitor your back...as there may be lingering issues for years

Not sure how it works but Tiff got turned away at two different doctors offices (urgent care/doc in the box type places) when she said she was in a car accident. Not sure why it matters but some places care how you got your injuries. All she wanted was someone to make sure she was okay or needed further medical assistance. Might want to call around before you drive to a particular place.

I concur. You want to get it checked out. Just because you feel ok and are a bit sore, doesn't mean you didn't cause some internal damage that will start affecting you in an hour, maybe a day, maybe next week, etc.

Go to the Dr. / ER and document everything. If your bike had aftermarket accessories you will be compensated for those as well. They may ask you to provide receipts but you can do an internet search for the prices and use those as a negotiating point if you don't have them.

I wouldn't get too worked up about trying to get replacement value for your bike. Go through the motions with the insurance and deal with that separately. If you have your own insurance, without a doubt, go get checked out. The longer you wait, the worse it is for you medically and legally. Do NOT come to any settlements until you seek legal advice, especially if you miss work. You most likely will get repaid for lost wages but it won't be until you reach your settlement. Don't be rushed into a settlement. In fact, some attorneys may help you financially to avoid rushing into a final decision. And once you sign, you should expect to repay your insurance for health care costs stemming from the wreck.

Again, GO GET CHECKED OUT!!! Immediately!!!

I was on a 2001 cbr f4i for the guy who asked...... It was clean as hell. He has allstate same as me so i have a good thing there.. Ill will go see a doc asap.. Thanks for the advice everyone....

You are entitled to documented lost wages.

I had a cherry older car that was worth more than the INS wanted to pay. I researched a similar car with same mileage and got the value for that car since it was the only one that compared to mine - it was almost 3 times what the INS offered. Food for thought.

Seek legal council.

What did the doctor say? Did they find anything?

First off, get medical attention ASAP. Secondly, be ready for a fight since you both have the same Ins company. Opposing Ins companies are slow enough, but I found that being hit by someone with the same Ins Co can take even longer. Though, I hope you won't have the same problems I did.

First off, I learned that not taking an Ambulance from the scene is like admitting that you don't have any injuries. I certainly wasn't banged up all that much. Even my medical costs were low, like only about $600. However, I had to fight to prove that my injuries were caused by the accident as I didn't got to the hospital directly from the scene in a meat wagon. My bike was repaired with no issues, which totaled more then 4k, but they fought me tooth and nail on $600 in medical and $300 in replacement gear costs. I didn't go after any lost work time as I just used my sick time to cover the 2 days I missed, I didn't go after any pain & suffering. It took me 8 months of fighting with someone every day to get things resolved and I still wasn't happy with the result, but was tired of fighting (which is exactly what they are going for).

So, get to a Doc quick, get everything documented and be ready for a fight, though I hope you don't have to have one.

Overall, sorry this happened to you and I hope your injuries are minor. Just glad you are still here to tell the tale.

Seek Legal counsel, Having the same insurance company is not really a good thing. Do not post your medical condition or how you feel fine on a public forum. Do not seek legal advice on a public Sportbike forum.

Went to doc today...I am messed up lot more than i thought... Thanks for the advice eveyone.. Getting xrays tomorrow... THIS SUCKS

Hope everything turns out well.

I know it's late but the emphatic rule should aways be go to the doctor. People have walked away from an accident only to be rushed to the hospital hours later when the situation is a lot worse.
