View Full Version : I hate businesses and lawyers

When we were in NJ, maybe in 08 we joined a gym. First it was my brother and I and then my wife joined for a little bit in or 09. Anyways my brother up and left and moved back to MD. When we were going to move down here we wanted to cancel our memberships. So one of the employees at the gym said to write a letter and bring it in but that they needed 3 month notice. So I didn't write a letter because I'm a badass but my wife did. So our bank card expire shortly after and I guess the gym couldnt get their money out. I was unemployed for most of 09 so I said F it. My wife gets a notice from the local court saying shes being sued. She called the lawyer today who was nasty (why are lawyers so nasty?) and he said that she needs to pay blah blah. She said she gave the person a letter at the gym and he said the contract she signed said the letter had to be sent certified mail. I think this is BS because I had 3 friends that joined the gym and they didnt send a letter through the mail they just brought the letter in. I think regardless my wife owes something, the lawyer said he would accept 1 month plus the $15 it cost to file a suit so shes just going to send off a MO. I just think the whole thing is funny that my brother didn't get any papers neither did I. Well I got a letter from the lawyer but nothing from a court. I would have thought it would be been done at the same time.

Gyms are the sleaziest operators in the business world. Every gym I've ever joined has eventually closed, usually without notice and in the dark of night. I guess that I spend too much time reading contract fine print, but I've never had a problem when I've moved or just decided to take my business elsewhere.

You mean hate? Just a little rant because they like to sue and screw the little guy. I guess I've been reading too many of those dealership threads.

I guess I dont understand how you are basically not doing anything except receiving a return on your investment and you say OK give us 3 months, regardless if you use the facilities or not. I thought Ballys was the only crazy gym people out there.

I have usually had good luck with pre paying for gym memberships so at the end I can walk without having to do anything. No letters, no bills, no lawyers. I am convinced that most of the problems people have are brought on by themselves.

yup - i have done that - this is my 2nd year at the same place - no lawyers sending me letters :D same with my golf memberships - i got 2 this year - no issues thus far

Not to be a dick, but by your own write up, you admit that you just bailed on your contract. As for the letter, certified mail would have been the only way to protect yourself. As for the lawyer, sounds like he was pretty reasonable to me offering you a settlement for one month + $15 court fee. They could probably pursue you for the whole contract if they wanted. I'd get a release in writing prior to sending money. If I were you, I'd send the money in the form of a USPS money order (I wouldn't send any collection agent/lawyer any thing that had my personal checking info on it) and send it certified so you have proof of who received and when.

Read again. I bailed on my contract but I'm not the one that was being sued.
