View Full Version : Atlanta Speeding Tickets on 85/75

this was in the car not on the bike ...
So I get pulled over and officer asks me how has I was going ... I say 60 in the 55. He says I was going faster, goes back to his cruiser and returns with two written citations. 1) for going 85 in the 55 and 2) for the super speeder law they just passed in GA saying I was going 85.
When dude comes back I ask him about the two citations he just wrote. I ask him if I can see what the laser or radar gun where he clocked me going 85. I ask him multiple times and he just walked away from me and said I'll see you in court. I was still trying to get his attention to ask him questions and he ended up just driving away while I was still parked on the side of the rode.
So I plan to fight both tickets and plead not guilty. But what should be the basis of my argument. I know for a fact he didn't catch me on laser or radar because he didn't write it on either ticket. He didn't calibrate either and didn't use either to write me the tickets. I also believe if he looked at his own speedometer to write the ticket all that proves is he was going 85 and not me.
Does anyone have any experience with this type of situation? Do I need to lawyer up or can I fight this one by myself? What do I need to tell the judge when I plead not guilty?
In full disclosure I do have 2 speeding tickets back in Nov 2009 which i pleaded guilty too. But for these tickets tonight I don't think the officer has a good case against me
Good luck. Since radar or laser is not on the citation, he was probably using his own speedo, and they can and DO write tickets all day like that. Its called "pacing", and they hold up very well in court.

I, for one, welcome our new, uniformed revenue collectors.
SuperSpeeder is simply an easy excuse for tax collection, and I feel confident that each officer is told they SHOULD write one an hour. Not a quota, but a really meaningful suggestion.
I know George Stein does DUI, but call him anyway.

If he didn't use a detection device, it's his word against yours. The cop normally wins in that case. But if you think it's worth paying a lawyer, have at it. But seriously, why not slow down a little?

Ya think? I didn't really hear that and don't think I'd believe it if I heard it. Doing 60 on the connector and got pulled over? You might sell that to somebody in Kansas City but I LIVE in Atlanta and I drive on the connector pretty often.
The speed limit of 55 is absolutely ridiculous.
A few years ago some college kids made a video about it. Pretty hilarious.

The irony is that what makes it ridiculous is the lack of enforcement. I travel to all parts of the country. In general, in most places, people exceed the posted limit a lot less than they do here. There are exceptions but the majority of places I go, most people are no more than 5 over and lots are at or under. Clearly, that's the result of enforcement. People are people so I don't believe they would all be going so slow unless they had a strong expectation of getting a ticket if they speed.

I can feel for this fella. Believe it or not, and this is Gods honest truth, I got a speeding ticket in ATL on 285 many years ago and the same thing happend to me. I didn't live here then, just visiting. Driving up 285 minding my own business, not even in the fast lane, and got pulled over. Cop told me I was doing over 100mph! Said she had to chase me for a mile at over 100 to catch me. The POS I owned then wouldn't even go over 100. She said she "cut me a break" and wrote me up for 85. Believe it or not this is EXACTLY what happened. Went to court and I "loosed" too but I tried. :lol: The system is corrupt and it sux! Good luck.

Guess the world will never know. We should all have our cars fit with a computer that records the exact speed we are doing during the entire drive. That way cops couldn't pace, visually estimate or any other false bullsh$%. Anyone see a problem with that? There would be no room for exaggeration by LEO. It would be cut and dry and the truth. I have no problem with it. If I am speeding I know it.

Exactly. That is the reason it won't happen. There would be no more revenue from speeders if nobody sped anymore. You think they actually want people to stop speeding? Fight it.... Get online and read up in the OCGA (Official Code of Georgia Annotated) section 40-14...all about speeding laws and the rules around enforcing them. What exactly is on the ticket? What law/code? Does it state he paced you? There was a guy on here before the crash that had a cd with info on fighting tickets. I would write more but it just gets folks panties bunched up at the thought of fighting a speeding ticket. I've had a bunch, and I've fought all of them. Won most. There have been occasions where the judge literally refused to go by the law and ignored it but that's the risk you take. Pay the fine or go and fight and possibly win. Worse case you still pay the fine....but atleast you fought. A lawyer will be $750 usually. I typically put up more of a fight for myself then a lawyer does. I've been in court where a dui case took 10-15mins and my speeding case took 3 hours...

Better yet, stop with fines, the hell with the revenue, make the first offense a $1000 fine, 2nd offense (if less than, oh, say 5 years) a 30 day suspension of driving privileges, and 3rd offense, 30 days in jail. Think THAT would slow people down?

Actually, I read an article where towns that had installed the camera enforced redlight violation systems were dismantling them because the revenue from redlight fines had went down drastically!!! Look it up! So the system worked to reduce redlight violations and thus accidents...but they removed it cause it also reduced the fine revenue.
As for me, I fight any tickets I get but also going to the race track has slowed me down a good bit on the road as well. I drive like grandpa on the way home Sunday evening. Guess I'm just to tired physically and mentally to worry with speeding....

There was more to it than that. The other component was that the software and cameras had to be updated yearly and the costs were apparently extremely high, as was the maintenance. When the revenue was reduced, so was the available money to maintain them. Thus the other reason for breaking them down.

I call BS. Why would everything have to be updated yearly? I can see if something breaks but just for a system to snap a pic and send it shouldnt require that much/many upgrades yearly. they installed them for "public saftey" not for revenue. I'm saying the only time that it would be used to determine whether or not we were ticketed was in the event of being pulled over. The cop pulls you over for speeding and says he visually estimated you at a certain speed, clocked you at this or paced you at whatever. There would be no discussion necessary because it would be right there on record.
I'm not talking about being able to abuse the things and send out random tickets in the mail. I don't agree with a system like that. But if it was only used to validate being pulled over, then things would be much more simple. No more people claiming what the OP is, and no more cops getting BS revenue when someone wasn't actually speeding. It would be solved right there. No more fighting it in court.
Have I broken the speed limit, of course. Do I do it regularly, not really. I had one ticket when I was 16 in St. Simons. Speed limit sign was covered up with tree growth. I'm 31 now. Pretty good track record.

spring 09 i was heading back home from myrtle beach and was 20-30 miles from covington on i20 . had the cruise on about 82-84... i was the tail gunner in a pack of cars.... I was kinda off in lala land just wanting to get home and off the road and looked in the rear view and saw a gsp chargerzip up behind me. so i signal and get in the slow lane... he hits the lights. blah blah blah... all the normal shit yea i know y i was speeding, hell i never even saw you officer im just ready to get home... he then informs me it took him 5 miles to catch me (BULL SHIT) and i was running 98. I said no sir i wasnt. well he was shock at the speed so he had to check it with his rear radar also i was told. I started to get pissy with him. I said sir if you look on my windshield you will see i have a gps i have had it on my entire trip from s.c. as you can kinda tell by the ploted tracking on the map and the trip milage... and if you look it also shows MAX speed and the average speed. the max speed was showing 86. then he spits out that its not acurate.... SORRY AGAIN SIR this gps is rated and approved for IFR flying.... dad got it for his backup unit for his plane..... so it is VERY acurate. I wasnt dening that i was speeding but i wasnt going 98 like asshat claimed i was. I then asked to see the cal. sheet on the radar units for that shift and i wanted to see him shoot the tuning forks that show 55. well i was told to stay in the car and a few min later was handed a ticket for 86. WHAT A PUSSY! dudes gonna try to rape me on a boguse speed that im SURE he never had radar readings from and thenuses my proof that hes full of shit to issue a ticket. I just shook my head that a ****. Yea i was speeding and got cought but it shouldnt have been issued a ticket cuz this dick was making up shit..... im not a big LEO fan.

Pacing is a valid method of detection for police officers but only if they can actually pace you. They have to be sitting behind you for a moment to match speed, pace and then they can pull you over. The other day I shot onto 285 from 400 and got moving a bit and then slowed down. A local LEO saw me and got behind me but by that time I had already slowed down to 65-70 and so he just bopped off.

I live in the American Gardens Building on W. 81st Street on the 11th floor. My name is Patrick Bateman. I'm 27 years old. I believe in taking care of myself and a balanced diet and rigorous exercise routine. In the morning if my face is a little puffy I'll put on an ice pack while doing stomach crunches. I can do 1000 now. After I remove the ice pack I use a deep pore cleanser lotion. In the shower I use a water activated gel cleanser, then a honey almond body scrub, and on the face an exfoliating gel scrub. Then I apply an herb-mint facial mask which I leave on for 10 minutes while I prepare the rest of my routine. I always use an after shave lotion with little or no alcohol, because alcohol dries your face out and makes you look older. Then moisturizer, then an anti-aging eye balm followed by a final moisturizing protective lotion.
